These Terms of Service ("Terms") cover your use of the Clearwater Offers website and what we do. Using the site or submitting a form means you agree to these Terms. If you don't agree, don't use the site.
1. Who We Are
Clearwater Offers is an independent cash buyer of land and single-family homes across the United States. We're not a licensed real estate brokerage. We don't represent sellers or buyers as an agent, and we don't offer brokerage services. When we make an offer, we're buying as a principal. Not acting as your agent.
2. The Offer Process
After you send us info about your property, we may dig into public records and comparable sales, and we may call you with questions. If we decide to make an offer, you'll get it in writing as a non-binding proposal. It only becomes binding once both sides sign a purchase and sale agreement. Until then, either party can walk for any reason or no reason at all.
If you accept, a licensed title or escrow company handles the closing. Any standard closing costs we agree to pay will be spelled out in the purchase and sale agreement.
3. Not Financial, Legal, or Tax Advice
Nothing on this site or in anything we send you counts as financial, legal, tax, or real estate brokerage advice. Deciding whether to accept an offer is on you, and we'd encourage you to talk to your own attorney, accountant, or financial advisor first.
4. No Guarantees
We try to keep our information accurate, but we don't guarantee that we'll make an offer, that any offer will hit a specific number, or that closing will happen by a certain date. Property valuations are estimates based on what we know, and they can change once we learn more.
5. Accuracy of Information You Provide
You agree the information you give us is true and accurate as far as you know. If the property turns out to be materially different than you described, we may revise or pull an offer. Knowingly false information can mean a withdrawn offer and, in some cases, legal liability.
6. Communications Consent
Submitting a form means you authorize Clearwater Offers to reach you by phone, autodialed or pre-recorded call, text, and email at the contact info you give us. Opt-out details and the full breakdown live in our Privacy Policy.
7. Intellectual Property
Everything on this site, including text, graphics, logos, and the Clearwater mascot illustrations, belongs to Clearwater Offers or our licensors and is protected under applicable intellectual property laws. You can view and print content for personal, non-commercial use. Reproducing, distributing, or making derivative works requires our written permission.
8. Prohibited Uses
You agree not to:
- Submit false, misleading, or fraudulent information
- Submit a property you don't own or have authority to sell
- Try to interfere with, probe, or compromise the site's security
- Scrape, harvest, or otherwise auto-collect data from the site
- Use the site to break any applicable law or regulation
9. Third-Party Services
This site runs on third-party services for hosting, forms, analytics, and communications. Those services have their own terms and privacy practices. We're not responsible for their content or policies.
10. Disclaimer of Warranties
The site and our communications come "as is" and "as available," with no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will run without interruption, be error-free, or stay free of viruses or harmful code.
11. Limitation of Liability
To the fullest extent the law allows, Clearwater Offers and its owners, employees, and contractors won't be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill tied to your use of the site or our services. Our total liability for any claim related to these Terms or the site is capped at one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Clearwater Offers and its owners, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorney fees) tied to your breach of these Terms, misuse of the site, or false information you provide.
13. Governing Law and Venue
These Terms are governed by Florida law, without regard to its conflict of laws rules. Any dispute tied to these Terms or the site has to be filed in the state or federal courts in Palm Beach County, Florida, and you consent to those courts' jurisdiction.
14. Severability
If any part of these Terms is held invalid or unenforceable, the rest stays in full effect.
15. Changes to These Terms
We may update these Terms now and then. Updates get posted on this page with a new "Last updated" date. If you keep using the site after that, you've accepted the new version.
